Municipality Resolves to Appeal Controversial Segapo Judgment

Vryburg – The recent judgment by the Mmabatho High Court declaring the appointment of Mr. MT Segapo as the Municipal Manager invalid has sent shockwaves through Naledi Local Municipality. However, the Municipality’s response to this verdict indicates that the battle is far from over.

In an official media release, on the Municipal Social Media Page, Naledi Local Municipality made a resounding declaration – they are appealing the court’s decision to the Supreme Court of Appeal (SCA) in Bloemfontein. This appeal process, they assert, effectively suspends the judgment, and Mr. Segapo will return to his duties as the Municipal Manager while the legal process unfolds.

The basis for this appeal lies in the Municipality’s belief that the concerns raised by the MEC COGHSTA (MEC for Cooperative Governance, Human Settlements, and Traditional Affairs) were addressed and clarified by the Municipal Council. These concerns, which allegedly pertained to errors and inaccuracies in the appointment process, prompted the court’s decision.

According to the Municipality, the court’s judgment, is not a reflection of Mr. Segapo’s qualifications, experience, or competency, as these have been deemed satisfactory. Instead, it revolves around the procedural aspects of his appointment.

This move by the Municipality has sparked spirited debate among residents and community members, with opinions divided on the matter. Supporters of Mr. Segapo hail the decision to appeal as a step towards justice and stability within the Municipality.

Mr. Segapo’s tenure, according to the statement, has already demonstrated positive outcomes for Naledi Local Municipality. It has led the way in project implementation and Municipal Infrastructure Grant (MIG) expenditure in the North West Province. Additionally, it says, the Municipality has been removed from the list of dysfunctional municipalities, thanks to the improvements in administrative stability and council functionality under Mr. Segapo’s leadership.

Disciplinary measures have been introduced to restore discipline and punctuality, while the Auditor General has commenced an external audit process aimed at improving the audit outcome and enhancing governance, it further states.

The statement maintains a position to remains resolute in its mission to stabilize administration, accelerate service delivery, and provide justice through qualified and capable leadership.
